9167200 Canada Inc. dba KANUK® (“we”, “us”, “our(s)”, “ourself/ourselves” and similar words) are proud to stand behind our authentic KANUK® products by offering our customers a full warranty with respect to any defects in our materials (exterior material or shell, and insulation) or workmanship in accordance with the below terms, resulting in a product not being of satisfactory quality. This warranty applies to all KANUK® products bought from us, whether originally purchased online at kanuk.com or in person from one of our KANUK® stores, and regardless of the country in which the purchase took place.
You will only benefit from the rights set out in certain sections of this warranty (and other sections will not apply to you) if you live in the United Kingdom (making you a “UK Consumer”). The sections of this warranty that only apply to UK Consumers (or do not apply to UK Consumers) are clearly labelled as such.
Your rights under this warranty will apply for the period set out against the relevant product category below:
*Trims are materials attached to or forming part of the coat or jacket (e.g., a fur or faux-fur trim on the collar or cuffs, an elastic waistband, epaulettes, piping around the collar, lapels or pockets, the interior lining (such lining being anything that is not part of the exterior shell)) that enhance the aesthetics or function of the item. Trims may require specific cleaning and be subject to care instructions which should be followed by the customer.
Depending on your jurisdiction of residence, the Warranty Term may apply differently to the items or products you purchase from us. For instance:
To be eligible for our KANUK® Warranty Solution (i.e., the rights set out in this warranty),
(a) you must be the original purchaser (meaning you purchased the KANUK® product concerned from us),
(b) you must provide proof and date of your purchase from kanuk.com or one of our KANUK® stores (noting either the original (or a photo of the) purchase receipt, are each sufficient) showing that your warranty claim is being raised within the applicable Warranty Term,
(c) our KANUK® label, logo and other insignia must not have been removed, altered or damaged beyond the claimed defect,
(d) your item must not have been altered or damaged (beyond the claimed defect) other than due to normal use, wear and tear,
(e) you must have followed the care and maintenance instructions indicated on the label or packaging, and
(f) the item must not have suffered damage due to your or someone else’s negligence or fault, or accident, or inclement weather (unless the primary function of the item is meant to withstand such inclement weather) or environmental factors.
If you are a customer other than a UK Consumer:
FOR REASONS OF HYGIENE, YOUR WARRANTY ITEM MUST BE FRESHLY LAUNDERED IN ACCORDANCE WITH THE CARE AND MAINTENANCE INSTRUCTIONS ON THE LABEL OR OTHER PACKAGING. WE WILL NOT ACCEPT OR RETURN ANY ITEM THAT DOES NOT MEET THIS CONDITION.
You are responsible to submit your warranty claim and item either in-person at our store located at 485 Rachel E. Street in Montreal (Quebec, Canada) or by courier delivery to the same address. You must package your item properly and you are responsible for the shipping and insurance costs for products delivered to our Repair Department at our Rachel E. Street store. It is safest to send us your warranty claim and item by Canada Post Priority Mail, UPS, Fedex or similar shipping method in your jurisdiction of residence that provides you with a tracking number and proof of our receipt. Only our signed delivery receipt will serve as proof of our receipt. We are not responsible for lost, stolen, damaged or misdirected (i.e., unreceived) packages or items.
If you are a UK Consumer:
You are required to submit your warranty claim to our Customer Service Team who can be contacted at info@kanuk.com. You must return the item (packaged properly) to the address we notify to you, and we will be liable for the cost of such return.
If you arrange for the item to be returned by a carrier of your choice, we are not responsible for lost, stolen, damaged or misdirected (i.e., unreceived) packages or items.
Our Repair Department, using its expertise, experience and discretion (acting reasonably at all times), will evaluate your warranty claim and get back to you with its decision within ten (10) business days. If you are a UK Consumer, in accordance with applicable laws, in certain circumstances you will benefit from a presumption that the product was defective on delivery.
Subject to applicable laws and all other provisions of this warranty, damages and defects that do not meet the above Warranty Conditions in our opinion (acting reasonably at all times) are excluded from our warranty coverage (i.e., you cannot benefit from the rights set out in this warranty in such scenarios), including but not limited to:
(a) (note this limb does not apply to you if you are a UK Consumer) damages not due to a defect in materials or workmanship;
(b) damages occurring, or claims made, outside of the Warranty Term;
(c) minor damages including loss, pull-through or migrations of feather or down stuffing;
(d) minor aesthetic issues including colour-fading or discolouration;
(e) tears, rips, cuts, burns or abrasions (unless these arise from the product's failure to comply with any descriptions or specifications disclosed at the time of purchase);
(f) damages to be reasonably expected from normal use, the passage of time, or usual wear and tear;
(g) damages from improper use, misuse, abuse or neglect or caused by you or someone else;
(h) improper maintenance and care (e.g., not in accordance with the care and maintenance instructions indicated on the label or packaging of the item for which your warranty claim pertains);
(i) items that have been altered or damaged including by tailoring, or improper laundering, ironing or storage;
(j) (note this limb does not apply to you if you are a UK Consumer) items with damaged, missing or torn labels, hangtags, holograms or date codes;
(k) damage caused by accident, inclement weather (unless the primary function of the item is meant to withstand such inclement weather) or other environmental factors;
(l) warranty claims with missing or improper documentation or without the item;
(m) items that are not authentic KANUK® products;
(n) second-hand KANUK® items (i.e., items for which you were not the original purchaser);
(o) (note this limb does not apply to you if you are a UK Consumer) items bought from us used or as-is or as a “final sale”;
(p) KANUK® items that are not bought online at kanuk.com or at one of our KANUK® stores unless there is proper proof of purchase; or
(q) where the claimant is not the original purchaser.
If we receive a proper warranty claim (i.e., a valid claim under the terms of this warranty), this is how we choose to make it right:
If you are a customer other than a UK Consumer :
Our initial solution is to repair the defect. If we determine that the defect cannot be repaired in a cost-effective way within a reasonable time frame, our secondary solution will be to replace your product with a new, identical item in style, size and colour, as available. If the same item is only available in a colour other than the original colour, we may offer you a different colour which you can decide to accept or reject. Replacement items – even if in a different colour – do not come with any new or additional guarantees, subject to the consumer protection laws that apply in your jurisdiction of residence. We will cover the cost of shipping back your repaired or replacement item to you unless we determine, in our sole discretion, that your warranty claim is unjustified, in which case you will have to provide us your credit card information to cover the cost of the return.
If the identical style, size and colour is unavailable, or if you do not want the alternative colour we offer you, our final solution will be to provide you with our choice, in our sole discretion, of a promo code or gift card of the same value as the price you originally paid, which can be used online at kanuk.com or in any one of our KANUK® stores within the next twelve (12) months.
If you are a UK Consumer :
You will benefit from the following rights with respect to products which do not comply with the terms of this warranty:
As an initial solution you can choose to: (i) receive a full refund; (ii) request a repair of the defect free of charge; or (iii) request a new, identical item in style, size and colour as a replacement free of charge. You must return the original product to us at our cost. You may not always have the option of choosing between repair or replacement, for instance if one option is impossible or disproportionately expensive compared to the other option. If the same item is only available in a colour other than the original colour, we may offer you a different colour which you can decide to accept or reject.
As a secondary solution (i.e., if the initial solutions set out above are impossible or not successful in rectifying the defect, or a new fault arises) you can choose to: (i) keep the product and receive a partial refund; or (ii) return the product and receive a full refund (subject to certain deductions in accordance with applicable laws).
Any refund will be made to the same payment method used for the original purchase, unless you explicitly agree to receive a promotional code or gift card of the same value as the price you originally paid (which can be used online at kanuk.com or in any one of our KANUK® stores within the next twelve (12) months).
All customers:
We will cover the cost of shipping back your repaired or replacement item to you unless we determine that your warranty claim is not a valid claim under the terms of this warranty (in which case you will have to provide us with your credit card information to cover the cost of the return, which you will be liable for).
